Terms and Conditions of Sale - DVD-and-Media.com
These terms and conditions are made between us, DVD-and-Media.com, and you, the "customer" in respect of purchases of goods from the DVD-and-Media.com website. You must agree to these Terms and conditions before you place an order with us. Your statutory rights remain unaffected.
Your Satisfaction
DVD-and-Media.com are completely dedicated to your total satisfaction. If you have any suggestions, comments or complaints please email us at customer-service@dvd-and-media.com or contact us on the details shown on the contact us page.
We will acknowledge any complaints within 5 working days (usually much sooner) and work towards a speedy resolution to your best satisfaction, dealing with your complaint confidentially and keeping you fully informed at all times.
Making a Purchase
Making a purchase could not be easier. Just browse our online catalogue, and click on any items that you wish to buy and put them into the shopping basket. After you have finished your selection, click on "go to payments" in the shopping cart and you will be asked for the remaining details that we need to be able to satisfy your order.
You can pay by credit/debit card or by cheque (payable to "DVD-and-Media.com"). We accept Visa, Mastercard, Switch, Solo and Delta. You may send your credit card information via phone,fax, or snail mail if you prefer not to use our secure online payment system. If your credit card or debit card is not authorized or declined, we will not process your order.
1.Purchase orders for goods.
1.1 Purchases can be accepted for delivery worldwide.
1.2 Each purchase order from www.dvd-and-media.com shall be deemed to incorporate these terms and conditions.
1.3 The display of products on www.dvd-and-media.com constitutes an invitation to trade and not a formal offer.
1.4 An offer will be made by the Customer on the completion of the purchase process contemplated in the ordering process set out in these pages.
1.5 An offer is only accepted by DVD-and-Media and DVD-and-Media only agrees to be contractually bound when DVD-and-Media despatches a confirmation of order to your e-mail address/postal address/fax number following receipt of payment, depending on the method of ordering adopted.
1.6 Goods are sold subject to availability and, in relation to certain specific goods, there are geographical restrictions.
1.7 DVD-and-Media reserves the right to alter the specification of the goods insofar as the performance of such goods is not materially altered.
2. Prices and payment
2.1 In addition to the list price of goods, DVD-and-Media.com reserves the right to make an extra charge for deliveries, the price of which will be calculated, communicated to and agreed with the customer prior to despatch.
2.2 Ownership of a good shall not pass until cash to clear funds for the full price has been received by DVD-and-Media.com until it has passed to the customer, the customer shall act as bailee of the goods for DVD-and-Media.com and, at so far as reasonably practicable shall store the goods so that they are readily identifiable as the property of DVD-and-Media.com.
2.3 DVD-and-Media.com reserves the right to refuse and cancel an account and /or delivery at any time prior to receipt of payment from the Customer. DVD-and-media.com also reserves the right to cancel an account and /or delivery when it can be reasonably demonstrated by DVD-and-Media.com that a credit card payment by the Customer is fraudulent.
2.4 Prices for goods are exclusive of UK Value Added Tax and other relevant sales tax unless otherwise indicated in the ordering process.
3. Delivery Schedule
3.1 Delivery shall be deemed to take place on the date of the first attempt at delivery to the customer's premises or other place specified for delivery. All goods must be signed for by an adult aged over 18 years or over on delivery, if no-one is at the address when the delivery is attempted the goods may be retained by the driver.
3.2 Working days are Monday to Friday excluding any Scottish Bank or public holidays.
3.3 Each order or each installment of an order shall constitute a separate contract.
3.4 In the event a delivery is attempted to your specified delivery address you will be carded by the delivery courier or postal worker, if you subsequently fail to undertake the instructions on the delivery card and the package is returned to our warehouse then delivery and packaging charges will not be refunded. This does not affect your legal rights
4. Back Orders
If your item is not in stock at the time of ordering, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait.
5. Cancellation and Returns
You have the right to cancel your order within 7 working days from the day after you receive the goods, i.e. you have effectively 8 working days after receipt of the goods to cancel your order should you wish to do so. All goods must be in perfect resaleable condition and be returned by recorded delivery to DVD-and-Media.com, return postage and carriage must be paid by you, if you do not return the goods within 7 working days from the point of your cancellation we will arrange to have the canceled goods collected from you and the cost of doing so will be deducted from your refund. Your money will be refunded within 30 days of your cancellation. DVD-and-Media.com may apply a restocking charge upto a maximum of 25% of the value of your order.
Damaged deliveries - PLASTICS
As we ship very large numbers of plastic and polypropylene cases it is unfortunately inevitable that, very rarely, however well we package these types of products there may be cases damaged by couriers or the post office. If you notice ANY damage to a box or parcel you receive from us it is prudent for you to sign for it as damaged as this allows a claim to be entered against the courier or post office. Where a box is signed for as damaged it is company policy NOT to dispatch replacement plastic items but to process a refund onto your credit or debit card to the value of the damaged items (you will be asked to email a digital photograph of the damaged items to sales@dvd-and-media.com)- we reserve the right to ask you to send the entire consignment or just the damaged items back to us - however we would rather not involve you having expense in sending items back, as you can hopefully appreciate it is totally uneconomic to send out 5 or 10 replacement cases from an order of say 1 or 200 cases - every incidence of damage is treated on its own merits. It is recommend you therefore order slightly more cases than your job requires and not the exact number where the job is crucial, remember plastics are fragile and couriers are heavy handed - we gaurantee to pack our items EXTREMELY well to protect them.
6. Credit Card Security
We take credit card security very seriously and employ the maximum possible measures on this site. All credit card transactions are dealt with by secure, online transaction systems. Your card details are encrypted on a secure server. It is practically impossible for your card details to be obtained by another party. 7. Guarantees and Liability
Everything sold on DVD-and-Media.com is covered by a manufacturer's guarantee. Should you not be satisfied with any product you purchased from us, simply return it to us unused as new and we will refund you in full or replace the product as you wish.
7.1 Goods sold by DVD-and-Media.com are sold with guarantee that they will be free of defects in material or workmanship at delivery and, provided they are used in the proper way, for the relevant period from delivery as indicated at the point of ordering.
7.2 DVD-and-Media.com accepts no liability for defects in goods resulting from customer designs or requirements, or arising from wear and tear, willful damage, negligence or misuse.
7.3 Information on www.DVD-and-Media.com may contain inaccuracies or typographical errors. Information and product specifications, including information relating to price and availability may be changed or updated without notice. No guarantee is given that the information accessible via www.DVD-and-Media.com is accurate, complete or current. Where a discrepancy on price or product description is discovered prior to entering into a contract with the Customer, DVD-and-Media.com will notify the Customer and communicate the correct price and or description and request the Customer proceed with their order based on the new information. www.DVD-and-Media.com may be temporarily unavailable from time to time. Nothing on www.DVD-and-Media.com shall be construed as a warranty or representation.
7.4 Except as otherwise stated in these terms, DVD-and-Media.com's entire liability in respect of a particular good that has passed into the ownership of a customer and the customer' remedies shall be limited to, at DVD-and-Media.com's option and in accordance with its returns policy from time to time, a credit note in respect of the amount paid by the customer to DVD-and-Media.com for such good; or the replacement or repair of the good by DVD-and-Media.com; or a refund where the good has been returned within a reasonable time.All customers shall be entitled to a full refund where they have properly rejected a faulty good within a reasonable time. Your statutory rights are not affected, where any consequential loss has occurred and where those losses were reasonably foreseeable DVD-and-Media.com will fully compensate the customer for those consequential losses.
7.5 Nothing in these terms shall limit or exclude liability for death or personal injury caused by negligence or for fraudulent misrepresentation, but except as otherwise stated in these terms and conditions, all conditions, warranties, terms and undertakings express or implied or otherwise, are hereby excluded to the fullest extent permitted by law. Your statutory rights as a consumer are not limited or excluded in any way.
7.6 DVD-and-Media.com shall have no liability to the customer for indirect or consequential loss except if it is a loss, which could reasonably be supposed to have been within the contemplation of DVD-and-Media.com and the Customer, at the time of the contract, as the probable result of any breach.
8. Compatible Cartridges
Compatible cartridges are defined as either new cartridges manufactured by a company other than the Original i.e. Inkrite produces compatible Epson cartridges, OR a remanufactured cartridge. All 'Compatible' Hewlett Packard cartridges featured on this site have been remanufactured to high standards by a UK based company.
